general terms and conditions for coaching


   



EnglishBusiness Zolezzi/Meinhof/Molohan GbR provides all prospective clients with unique training and coaching in English. The content, structure and objectives of our courses are tailored according to the client’s previous knowledge. The following general terms and conditions apply at all times.

1.    Purpose of terms and conditions
The following terms and conditions are relevant for participation in the training and coaching activities of EnglishBusiness.   

2.    Scope of service
The scope of the contractual service is based on the general content/objectives and how these are individually tailored to meet the requirements of the participants. It is also based on any agreements made between the contractual partners in relation to these.

3.    Non-occurrence of courses
If there are insufficient participants registered for a course or if a course cannot take place as planned due to circumstances beyond EnglishBusiness’s control, EnglishBusiness is not obligated to carry out the course. Any persons registered will be informed of the situation in due time before the course commences.

4.    Terms of payment
Fees corresponding to the scope of service which have been specified in a contract should be paid in advance into the relevant account once the contract has come into effect. Unless otherwise agreed, payments should be made in monthly instalments. The participant/company is obligated to pay on time.

5.    Absenteeism
Participants are obligated to pay the fees for a course even if they do not attend the course or only attend it in part. Any exceptions to this are the subject of individual contract terms.

6.    Withdrawals
If a participant withdraws from a course more than six weeks before the individual start of the course, no costs will be incurred. For withdrawals occurring between two and six weeks before the course commences a processing fee of EUR 30 will be charged. Withdrawals occurring any later than this will incur the same charge that would be due for participation and immediate cancellation at the next available date.

7.    Cancellation
If classes are cancelled due to the fault of EnglishBusiness during a course, an agreement will be made on a consensual basis with the participants to make up the classes cancelled or provide reimbursement for the classes cancelled.
 
8.    Cancellation of contracts
A cancellation period of 6 weeks applies as a rule for an open-ended contract. Fixed-term contracts expire on the date specified in the contract. Cancellation alternatives and periods are the subject of individual contract terms. An automatic contract extension can be agreed upon in writing between the contractual parties. Extraordinary cancellations for cause are reserved.

9.    Changes
Any deviations from the above terms and conditions must be made in written form. Unless particular provisions have been made in the above terms and conditions, the general legal provisions apply.

10.    Other terms and conditions
The rights and obligations arising from this contract are not transferable. German law applies to the contractual relationships between the parties.
